The plant in Georgia that produced peanut butter tainted by salmonella has a history of sanitation lapses and was cited repeatedly in 2006 and 2007 for having dirty surfaces and grease residue and dirt buildup throughout the plant, according to health inspection reports. Inspection reports from 2008 found the plant repeatedly in violation of cleanliness standards.

The state performs the inspections on behalf of the Food and Drug Administration as part of a contractual agreement with the federal agency, officials said.

This was the only new piece of the story for me and interesting the FDA is not doing its own work!

Of the total funds for food safety, the FDA gets roughly 20%, whereas Ag gets 80%. The regulatory burden, on the other hand is just about reversed: FDA has about 80% of the responsibility, and Ag only 20%. This is true regardless of the Administration in power. They simply can't do everything themselves. They aren't funded for it.

Also, you may be shocked to know that under the FFDCA, the FDA cannot impose a mandatory recall on foods. On drugs and medical devices, they can. There is no legal basis for mandatory food recalls, however. This may change, if the Congress gets time to address FDA reform in this session.

(Coincidentally I am recording a basic Food Law course this morning. This very topic came up less than a half hour ago.)
